Where is Kuldeep Singh, the key witness in the Jaswant Singh Khalra case?

Special Police Officer (SPO) Kuldip Singh was the most critical and central legal link in the Jaswant Singh Khalra abduction and murder case. It was on the basis of his testimony that the apex courts of the country sentenced the guilty police officers.

According to court documents and the Supreme Court’s 2011 judgment (Prithipal Singh & Ors v. State of Punjab), the key facts regarding SPO Kuldip Singh are as follows:

1. Role During the Incident and the “Accomplice” Label In the year 1995, Kuldip Singh was posted at the Jhabal police station in Tarn Taran and was on duty as the bodyguard of SHO Satnam Singh. He was present at the location where Jaswant Singh Khalra was kept in illegal custody. He served food to Khalra, witnessed him being beaten, heard gunshots, and was later part of the police convoy that threw the body into the Harike Pattan canal. For this reason, the court legally considered him an “accomplice” (a person who was present at the crime scene but did not prevent the crime).

2. Long Silence and the First Disclosure Following Khalra’s abduction, Kuldip Singh remained completely silent for nearly two and a half years. According to his own statement, the terror of the then Tarn Taran SSP, Ajit Singh Sandhu, was so immense that he could not speak out. After Sandhu’s death in 1997, Kuldip Singh contacted the Khalra Action Committee in January 1998. On March 2, 1998, he recorded his first voluntary statement at the CBI office in New Delhi. Subsequently, in May 1998, his interview was published in The Indian Express newspaper, making the horrific details of this murder case public for the first time.

3. Why He Was Not an “Approver” People commonly refer to Kuldip Singh as a ‘government witness’ (approver), but legally he was not. Under Section 306 of the Code of Criminal Procedure (CrPC), an approver is someone who is himself named as an accused in the case and strikes a deal to speak the truth in exchange for a pardon. Kuldip Singh was never named as an accused in the CBI charge sheet; therefore, he testified voluntarily without any legal deal or promise of immunity.

4. Pressure and Wavering Courage Prior to the trial, in April 1998, Kuldip Singh’s courage wavered due to heavy police pressure and threats. He went missing for some time and even submitted a written complaint against Jaswant Singh Khalra’s wife, Paramjit Kaur. However, when the court trial commenced in 2005, he appeared in court under CRPF protection (as witness PW-16) and completely stood by his original statement, rejecting all police pressure.

5. “Star Witness” and Case Outcome From the trial court to the Supreme Court, Kuldip Singh was recognized as the “star witness” of this case. His eyewitness testimony was the primary foundation that proved Khalra had been murdered. Due to his bravery, the Patiala Sessions Court sentenced the guilty policemen in November 2005, a ruling upheld by the Supreme Court on November 4, 2011, sentencing four former police officers to life imprisonment.

6. Current Status Even after testifying, Kuldip Singh’s life was fraught with danger and stress. In March 2011, there were reports of him going missing for a few days, but he eventually returned. Following this, he completely withdrew himself from the public limelight and media. Today (in the year 2026), there is no official information available in public records regarding his residence, occupation, or current life, which is also highly necessary for his personal security.
