 Supreme Court Makes Big Statement in Pegasus Case

During a hearing on the Pegasus spyware case, the Supreme Court of India made a significant observation on Tuesday. The court questioned, “If spyware is being used in the country, what’s wrong with it?” This remark has stirred discussions around privacy, surveillance, and national security.

According to Bar and Bench, the apex court stated that there is nothing inherently problematic about the existence or use of spyware. The bench remarked, “Let us be clear — there is no issue with spyware as such. It can be used on select individuals. After all, we cannot compromise national security.”

However, the court emphasized that the crucial question is who the spyware is being used against. If it is being deployed against members of civil society, the matter deserves serious consideration.

Additionally, the court clarified that the report submitted by the committee investigating the alleged Pegasus surveillance cannot be made public.

This case revolves around allegations that the Pegasus spyware, developed by Israeli firm NSO Group, was used to surveil journalists, activists, and opposition leaders in India — a charge the government has consistently denied.
