Amid tighter immigration enforcement under the Donald Trump administration, the Indian Embassy in the United States has issued an important advisory for Indian travelers regarding the duration of their stay in the country. The embassy has clarified that the length of stay permitted in the US is not determined by the visa’s expiry date, but by a separate authorization issued by US border officials.

In a post shared on social media platform X, the Indian Embassy said that the US Customs and Border Protection (CBP) officers at the port of entry have the authority to decide how long a foreign visitor can remain in the United States. Travelers have been advised to carefully check their I-94 form, which officially records the authorized period of stay.

“Attention! The duration of stay in the United States for a foreign visitor is determined by CBP officers and is not linked to the visa expiration date,” the embassy stated. “To know how long you are permitted to stay in the US, please refer to your I-94 form, which clearly mentions the number of days authorized.”

What Is the I-94 Form?

The I-94 form is a critical immigration document issued to all non-immigrant travelers entering the United States. It specifies the date until which a visitor is legally allowed to stay in the country. This date may differ significantly from the visa expiration date printed on the passport.

According to the US Department of Homeland Security, travelers arriving in the United States by air or sea are automatically issued an electronic I-94, and no separate application is required. The form can be accessed online and should be checked immediately after arrival to avoid any unintentional overstay.

However, travelers entering the US through land borders are required to apply for an I-94. To reduce waiting time at border checkpoints, this application can be submitted in advance through the official US government website.

It is important to note that immigrant visa holders are exempt from this requirement.

Why This Advisory Matters

The Indian Embassy noted that a similar advisory had been issued about two months ago, but the renewed reminder comes at a time when immigration scrutiny in the US has intensified. Overstaying beyond the date mentioned on the I-94— even if the visa is still valid— can lead to serious consequences, including fines, future visa denial, or entry bans.

Broader Immigration Context

The advisory also comes against the backdrop of stricter immigration measures introduced by the US administration. Recently, President Donald Trump announced travel restrictions on citizens from 19 countries, including Afghanistan and Syria, reinforcing the administration’s hardline stance on immigration and border control.

Indian travelers planning to visit the United States— whether for tourism, business, or education— are therefore strongly advised to verify their I-94 details, understand their authorized stay, and ensure full compliance with US immigration laws to avoid legal complications.
